1 Pursuant to Article 95, item 3 of the Constitution of Montenegro Decree on the proclamation of the Law on the Protection of Animal Welfare I am promulgating the Law on the Protection of Animal Welfare, which was passed by the Parliament of Montenegro at its session Second Extraordinary Session in 2008, on February 12, Number: / 2 Podgorica, February 21, 2008 President of Montenegro, Filip Vujanović, s.r. Law on the Protection of Animal Welfare The Law was published in the "Official Gazette of Montenegro", no. 14/2008 of years. I. GENERAL PROVISIONS Subject of the law Article 1 This law regulates the rights, obligations and responsibilities of natural and legal persons for the protection of well-being in relation to the protection of animals from torture, in the holding and breeding, at the time of killing and slaughter, in performing animal care, transport and experimentation, animal welfare rules, as well as other issues of importance for the protection of animal welfare. Applying the law Article 2 This law applies to all animals, and in particular to: 1) animals that are reared and reproduced for the production of food, wool, leather, fur and other economic purposes (hereinafter: production animals); 2) Pets; 3) abandoned, lost and dangerous animals; 4) animals in zoos, shelters or nurseries; 5) animals in circuses and other performances; 6) animals used in experiments.

2 This law does not apply to embryonic and fetal developmental stages of animals. This law does not apply to management of hunting grounds, except for the breeding and keeping of animals used for hunting assistance. This law does not apply to fish farming and fishing The meaning of the term Article 3 Some terms used in this law have the following meaning: 1) the animal is every vertebrate, except for a person who is able to sense pain, suffering, fear and stress; 2) animals for production are animals that are reared and reproduced for food, wool, leather, fur and other economic purposes; 3) animals whose survival depends directly on humans are animals for production, experimental animals, pets and animals kept in circuses, zoos, shelters, or nurseries; 4) a lost animal is an animal that the owner has lost by his will; 5) abandoned animal is an animal that has no home or is outside of it, deprived of care and care the keeper, whom he consciously abandoned; 6) Pets are animals raised or raised for the purpose of recreating, protecting or assisting a person (dogs, domestic cats, exotic and decorative birds, small rodents, terrarium, aquariums and other animals); 7) Pet sale facilities are shops where pet, food and poultry sales are made pet accessories; 8) the hygiene and exterior beautification facility is an object for hygiene and beautification skin, hair and nail of animals; 9) a dangerous animal is an animal that can endanger the environment or human being because of its nature or aggressiveness; 10) pet is an object in which pets are held and reproduced in commercial purposes; 11) shelter for abandoned animals (pets) is a place with facilities in which they are temporary or permanent accommodation of animals (abandoned and lost) for further care and possible adoption 12) a pet pension is a place with facilities in which the holder, with a monetary compensation, temporarily places a pet; 13) working animals are animals used to help humans (dogs used to hold the face and property, assistance to persons with disabilities, hunting, horses and other animals served by man); 14) official animals are animals that are trained and used to perform the work of individuals state authorities (service horses and dogs);

3 15) foreign (allochthonous) animal species are animal species living in an ecological system different from the system from which they originate; 16) experimental animal is any living vertebrate, except human, invertebrates, their developmental forms intended for the performance of the experiment; 17) The experiment is any procedure or procedure on animals that is carried out in scientific research or Educational purposes which can cause pain, suffering, persistent injuries or death; 18) the zoo is a place with facilities where domestic and wild animals are kept or reproduced, for the purpose of preserving endangered species and showing the public at least seven days a year for the purpose of promotion biological education and upbringing of man; 19) circuses are performances with animals organized by the legal or natural persons in which they participate animals, for the entertainment of the audience; 20) the holder of an animal is a company, an entrepreneur, or another legal and natural person who is the owner of the animal, that is, the person authorized by the owner for permanent or temporary storage animals other than carrier; 21) the carrier is a commercial company or an entrepreneur transporting animals; 22) transport is the movement, or the journey of animals from the place of departure to the place of destination, including loading, unloading and accommodation; 23) means of transport are road and rail vehicles, ships and aircraft (aircraft) used for the transport of animals; 24) the animal accompanying person is the person responsible for the protection of the life and welfare of animals during transport; 25) the attention of a good host is to provide conditions for animals that satisfy her life needs (sufficient quantity of quality food and water, space for movement, rest and shelter, respectively microclimatic and hygienic conditions of life, preservation of physical, psychological and genetic integrity, undertaking and implementation of preventive, diagnostic, hygienic, therapeutic and other measures for preservation health condition of the animal, prevention of injuries, diseases of various causes, stress, pain, suffering, fear and death); 26) good veterinary practice (hereinafter: DVP) are ethical and professional standards behavior of veterinarians; 27) a procedure is any interventions that are carried out on animals that prevent or cure diseases and injuries, or changes the physical, psychological or genetic integrity of the animal; 28) analgesia is a method of reducing or eliminating the pain of an animal being carried out analgesics, without loss of consciousness;

4 29) anesthesia is a process of exclusion of pain in an animal that is administered locally or in general anesthetics; 30) stunning is a mandatory process that is carried out before slaughtering or killing animals that cause it the current loss of consciousness that lasts to death; 31) being a victim is the process by which the animal is taken away from life; 32) slaughter is the way of killing animals by bleeding, after stunning, for the production of food; 33) ritual slaughter is slaughter of animals without prior stunning performed by a person authorized by religious communities registered in Montenegro. II. PROTECTION WELFARE Caring for animals Article 4 Every person who meets the requirements for the protection of the life and welfare of animals has the right to hold animals in accordance with this Law. Every person is obliged to take care of the animals, especially animals whose survival depends directly from him. The keeper of the animal is obliged to treat the animal with the care of a good host and an animal provide the living conditions appropriate to its species, race, gender, age, as well as physical, biological and production specifics, behavioral characteristics, or animal health status. The keeper of the animal is responsible for the life and welfare of the animal, as well as for the damage that it can inflict on others persons or animals. The keeper of the animal shall be obliged to prevent an animal from endangering the life, safety or property of another person, that is, the life and safety of another animal. The obligation to provide assistance Article 5 A person who hurts an animal must provide assistance to her, and if she is unable to provide assistance, it is obliged to provide assistance to the animal. Animal keeper is obliged to provide veterinary assistance in the event of injury, illness and hardship childbirth. Prohibition of torture and killing of animals Article 6 It is forbidden to torture and kill animals for no reason. Torture of animals Article 7 Torture is: 1) denial of basic living needs (food, water, comfortable accommodation, or shelter, space for rest and exercise of physiological needs, hygiene and health care); 2) physical maltreatment (hitting, hanging, tying petards and other pyrotechnics for animals, forcible prosecution, forcing excessive work that exceeds the endurance of animals); 3) choking or drowning of animals;

5 4) exposure to open fire, chemicals that can cause animal pain or killing; 5) subjecting them to psychological abuse and mistreatment (preventing them from satisfying their basic needs needs in behavior, manifest basic forms of behavior, use space for rest and shelter, exhaling animals using physical force, other animals or irritations which are not inherent to it, by applying fear, suffering and causing feelings of insecurity, as well as preventing the establishment of a link with animals of the same species) that violate the psychic integrity of the animal and cause changes and behavioral disorders; 6) carrying out interventions and experiments contrary to this law. Prohibited procedures for the protection of animals Article 8 It is forbidden: 1) leave the domestic animal, pet or breeding wild animal and other animals being kept under control; 2) the killing of animals, except in the cases and in the manner prescribed by this Law; 3) to raise animals in a way to suffer pain, suffering and fear and deliberately hurt them; 4) increase the aggressiveness of animals by selection or other methods; 5) hacking animals to other animals or humans, or slashing them to aggression, except for the official dressage dogs under the guidance of trained persons; 6) train animals for fighting, organize animal struggles or fight between animals and humans, participate In them, visit them, advertise and organize betting and participate in betting; 7) give live animals as rewards in games of chance; 8) use technical devices, auxiliary devices or devices that affect the behavior in the form of a penalty animals, including barbed necklaces or dressings with the use of electricity or chemicals matter, except for dressage of official and hunting dogs, in accordance with the law; 9) organize dog races on hard surfaces; 10) give stimuli or other illicit animals to animals in order to improve their appearance on sports competitions and performances; 11) use unauthorized stimulus and substances for the purpose of faster growth and animal growth; 12) use animals for circuses and other performances, film and television recordings, advertising

6 messages or advertising, exhibition or competition, if it involves unnatural behavior or is animal causes pain, suffering, injuries or fear; 13) forcing animals to behave in a way that causes them pain, suffering, injury or fear, or rather getting used to unnatural forms of behavior; 14) exposing animals to unfavorable temperatures and weather conditions, contrary to zoohygienic standards for a particular type or lack of oxygen; 15) give animals food or matter whose taking causes pain, suffering, injuries, fear or death; 16) forcing animals to take certain substances or food, unless determined by the veterinarian veterinary-health purposes or if it is not scientifically justified; 17) ignore animals in terms of their health, housing, nutrition and care; 18) to live animals to cut sensitive parts of the body, except for the purpose of protecting the health of animals, in zootechnical or experimental purposes; 19) use inadmissible traps for capturing animals; 20) feed animals to other live animals, unless it is inevitable or is the only way to feed these animals; 21) to use live animals as bait for hunting or for training animals; 22) restrict movement to animals in a way that causes them pain, suffering, injuries or fear; 23) to stun, slaughter or kill animals for ritual purposes; 24) release into the wild a reproduced, or homemade wild animal if it is not previously prepared for survival in such a living space, in accordance with the law; 25) reproduce animals with hereditary disorders that endanger her well-being or well-being of her offspring, except in the case of induced mutations, in accordance with this law, as well as reproduction animals that have not reached full maturity; 26) subjecting, allowing or permitting an animal to be subjected to intervention, which is carried out without professional care and humanity and contrary to the rules of good veterinary practice. The conditions and manner of dressage of official dogs and horses is prescribed by the ministry responsible for internal affairs cooperation with the ministry responsible for defense and the ministry in charge of veterinary affairs (in hereinafter: the Ministry). III. PROTECTION OF ANIMALS IN THE HEALTH CARE PROTECTION I ZOOTEHNIČKI ZAHVATA Article 9

7 An animal's endangering the physical, psychic, or genetic integrity of an animal can performed only by a veterinarian, and for scientific research and biomedical purposes and an authorized scientist, in accordance with this law. Surgical and zootechnical procedures on animals, except in the cases referred to in paragraph 3 of this Article, must be performed with the application of anesthesia, and in the postoperative course of analgesia, in accordance with the rules of veterinary profession. Assays in animals without the use of anesthesia may be carried out in the following cases: 1) if anesthesia can cause death of the animal; 2) in the marking of animals; 3) in carrying out certain diagnostic procedures - testing in accordance with the rules of the profession; 4) if anesthesia causes more pain than it causes itself; 5) if it is contraindicated by the experimental results that the experiment is trying to determine. Procedures and procedures related to animal procedures carried out by a veterinarian must be in accordance with good veterinary practice (DVP). Prohibition of animals on animals Article 10 It is forbidden to carry out interventions on animals in order to change the exterior or identity of an animal, concealment of physical defects and old age, or partial or complete amputation of certain parts animal body, and in particular: 1) cutting and shortening of the tail in all animals, except for piglets younger than eight days; 2) cutting of the ear shell; 3) removing the sound wires (devocalization); 4) cutting claws with fingertips and removing poison teeth; 5) painful stalking; 6) shortening the beak to the cattle unless it is done with the intent to prevent greater losses and diseases in holding or reproduction; 7) castration of rays with an elastic ring; 8) interventions at the full bodies of males other than castration; 9) stamping of sheep and cattle; 10) cutting the tongue with calves; 11) cutting horns with calves and rams;

8 12) disabling the cats to advertise by inoculation; 13) interventions on livestock that prevent them from using wings, in addition to shortening the wings; 14) affecting vision weakening in poultry. Notwithstanding paragraph 1 of this Article, animal interventions may be carried out in the following cases: 1) for the purpose of health protection, ie prevention of endangering the life and welfare of the animal; 2) for scientific research and biomedical purposes, in accordance with the law; 3) to control the animal population (sterilization); 4) for the marking of abandoned animals, the sealing of the ear shell; 5) for zootechnical purposes, if such a procedure prevents pain, suffering and self-injury of animals or injury to other animals and for safety reasons. IV. PROTECTION OF ANIMALS FOR PRODUCTION IN STATE AND EDUCATION The obligations of the keeper of animals Article 11 The keeper of animals is obliged to provide animals: 1) food and water according to their physiological needs; 2) care and health care; 3) accommodation in an object with sufficient light, heat and space; 4) hygiene of space; 5) protection against the impact of weather and natural enemies. Animals temporarily or permanently not placed in facilities must be protected against adverse effects weather conditions and other hazards to health and life. An animal keeper cannot be a face under 16 years old and cannot be sold or given to animals. If a person under the age of 16 has an animal, the animal's keeper is considered to be the parent or guardian of the animal faces. Animals held by a closed holder are obliged to visit, at least once a day. Construction and equipment of buildings Article 12

9 Material used to construct objects and equipment in objects with which animals come in contact does not they can be hazardous to animals and act harmful to their health and must be built so that they can easy to clean, wash and, if necessary, disinfect. Objects and facilities for accommodation of animals and equipment must be constructed so that they do not have sharp corners, edges or protuberances that could hurt the animals. Automatic and mechanical equipment used for keeping animals must be regularly monitored, at least once a day. Closer conditions to be met by facilities and equipment for keeping and breeding animals for production and mode management is prescribed by the Ministry. Animal movement Article 13 Animals must have available space that suits their physiological and ethological needs. An animal whose freedom of movement has been denied must be provided with an accommodation in which it is free difficulties can lie down and rise, stretch front and back legs, freely stretched and on the same surface and in the same space, without bending of the hull and head, can freely turn in the stand and in the lying position around its longitudinal axis. Feeding and powering Article 14 Animals must have access to sufficient quantities of water of adequate quality in accordance with their own needs. Objects in which animals are kept must be equipped so that animals can take food and water on way appropriate to their type. The premises and equipment for feeding and powering must be regularly maintained or cleaned. It is in case of illness or injury Article 15 The keeper of the animal shall place the diseased or injured animals in accordance with their needs, and if necessary, in special rooms or facilities and provide them with veterinary and health care. A sufficient number of trained persons or persons with equal value must be taken care of for animals experience. V. PROTECTION OF ANIMALS IN ACCUSATION AND MOMENTATION Protecting animals at killing Article 16 An animal may be killed only for justified reasons and under certain circumstances. Animal smuggling can be carried out if: 1) the treatment of animals takes a long time, and the outcome of treatment is uncertain; 2) the animals, due to their age, cancels basic life functions; 3) is incurably ill, injured, physically deformed or otherwise pathologically incapacitated

10 so that the recovery of an animal is not possible and life for it is a source of constant pain, suffering, fear and stress; 4) prevent the spread, suppression and eradication of infectious diseases in accordance with the law; 5) the animal is dangerous to the environment, ie it cannot be adapted to the conditions of captivity, and its release is a danger to humans, other animals and the environment; 6) is implemented for the purpose of controlling pests, and otherwise it cannot be implemented; 7) is necessary in order to maintain the natural balance in the hunting ground, in accordance with the law; 8) it is necessary to provide products of animal origin for human consumption and other economic purposes; 9) is used for scientific research and biomedical purposes, in accordance with this Law. It is forbidden to kill animals: 1) by applying physical force - by choking, drowning, beating, etc.; 2) the use of toxic substances or medicaments not intended for this purpose in accordance with the instructions manufacturers; 3) using an electric current in a way that does not lead to the instantaneous loss of consciousness; 4) motor vehicle traffic; 5) using weapons, except in cases established by law; 6) other similar methods; 7) for ritual purposes. Animals must not be killed in public places, except in hunting grounds in accordance with law, when it is necessary that the animal be deprived of unnecessary pain and suffering, and its recovery, due to injuries and health it is not possible to prevent the spread, suppression and eradication of infectious diseases. Animals may be killed only by a veterinarian or veterinary technician under the supervision of a veterinarian, except in cases: - killing - the slaughter of animals that are reared and kept for food production; - the killing of animals for the purpose of education and experimentation;

11 - pest control; - the killing of animals suffering from impotent pain. Redeeming is done in a way that ensures complete loss of consciousness or immediate death. Animal death is performed with a previous stunning, followed by a procedure that causes a safe death without the possibility of animal recovery. Animal deaths contrary to this Article shall be considered torture of animals. Animal deaths are carried out with special purpose vehicles. Treatment with an animal suffering from impotent pain Article 17 The keeper must, without delay, be killed by an animal suffering from severe and unbearable pain that has occurred as a the consequence of more force. Protecting animals for the production of killing and slaughter Article 18 When slaughtering animals for production, the stunning must be done before bleeding causes an immediate loss of consciousness. By way of derogation from paragraph 1 of this Article, the animals for production can be slaughtered without any previous stunning In the following cases: 1) slaughter of livestock and rabbits in the household for their own use, in the manner and means that lead to instant death; 2) forced slaughter for the purpose of interrupting the pathological state of the animal that can lead to death due to severe injuries caused by an accident or for other health reasons, if there are no conditions for stunning; 3) ritual slaughter. Closer conditions for the protection of animals for slaughter production, the method and the means for stunning and animal killing, as well as the manner of training of persons referred to in Article 20, paragraph 6 of this Law Ministry. Stunning animals Article 19 Animals must be brought into the state of loss of consciousness and slaughtered in that state. Stunning should not be performed if it is not possible to slaughter-bruise immediately after the stunning of the animal. Animals used for the production of fur are killed after stunning, without slaughter.

12 The use of resources (dagger, hammer, ax, etc.) is prohibited and the application of stunning procedures which inflict unnecessary pain, suffering, injuries and fear on animals. Treatment with animals in the slaughterhouse Article 20 The unloading of animals and the movement of animals within the circle of the slaughterhouse must be carried out in such a way that the animals are kept to spare anxiety, fear, suffering and pain, using appropriate equipment. After unloading, animals must be placed in appropriate premises or accommodation for animals so they are protected from unfavorable climatic conditions and must be provided with sufficient water for them charging. Animals that have not slaughtered within 12 hours of their arrival at the slaughterhouse must be kept moderate amounts of food at appropriate intervals. Animals must be stunned just before slaughter. In the case of animals being crashed, no means of causing pain or suffering should be used, or not they can tie their hind legs, snatch animals before stunning, or before bleeding in the case ritual slaughter, etc., other than poultry and rabbits that can be hung for slaughter, provided that after hanging out immediately. Moving, accommodation and caring for animals in the slaughterhouse, hiding, stunning and slaughtering or killing animals can only be trained. Automatic and mechanical equipment-means for unloading, cluttering, stunning, killingslaughtering animals must be regularly maintained and controlled. Article 21 it is forbidden: 1) slaughter an animal if no veterinary examination was performed prior to slaughter; 2) slaughter if the animal is not stunned in a prescribed and expert way, except in the case of ritual slaughter or if the animal is agonizing; 3) continue the processing of slaughtered animals if the bleeding is not fully completed. VI. PROTECTION OF HOME LOSSES Article 22 A pet owner is obliged to provide a pet with comfortable accommodation, caring and nursing care in accordance with the type, race, sex, age, physical and biological specificities and behavioral needs and animal health status. The pets keeper is obliged to provide reproduction control and take care of the cubs pets, and in case of uncontrolled reproduction when they do not want or are not able to worry about cubs, is obliged to bear the costs of their care. The pet owner is obliged to remove the ejection of his pet from the public areas. Article 23

13 Breeding of pets intended for reproduction for commercial purposes with three or more breeding females can be performed in kennels that meet the requirements regarding facilities, equipment and conditions necessary for the protection of animal welfare. Dog training can be done in facilities that meet the prescribed requirements. The fulfillment of conditions from paragraph 1 and 2 of this Article shall be determined by the authority responsible for veterinary affairs (in hereinafter: the administrative body). The administrative body shall keep a register of kennels and dog training facilities referred to in paragraphs 1 and 2 of this Article. Closer conditions from st. 1 and 2 of this Article and the manner of keeping the register referred to in paragraph 4 of this Article shall be prescribed by the Ministry. Protection of pets in facilities for sale and hygiene facilities and exterior beautification of animals Article 24 Pet sale and exterior beautification can be done at the facilities that fulfill it veterinary and sanitary conditions and conditions necessary for the protection of animal welfare. The administration body maintains a register of facilities for the sale of pets and facilities for the exterior beautification and determine the fulfillment of the conditions referred to in paragraph 1 of this Article. In pet sale and hygiene facilities and exterior beautification of animals an employee must be trained in the care of animals. In the pet sale facility, an employed person is obliged to issue written instructions on how to do it the keeping of animals that sell and keep records of the persons to whom the animals have been sold. Pet sale is forbidden to persons under the age of 16 years without the consent of the parent or guardian. Animals for sale must be encouraged from registered objects or from registered holders. More detailed requirements from paragraph 1 of this Article, the manner of keeping the register referred to in paragraph 2 of this Article and the manner of training persons referred to in paragraph 3 of this Article shall be prescribed by the Ministry. Protection of abandoned and lost animals (pets) Article 25 The keeper of the lost pet is obliged to report the disappearance to the shelter for abandoned animals. A person who finds an abandoned or lost animal (pet) is required to inform the shelter for abandoned animals. The cost of accommodation in the shelter is paid by the keeper of the animal, if known or subsequently determined. The found wild animal can be handed over to the closest hunting society for its return to nature or the nearest zoo that is equipped for its placement. If the zoo is not possible To receive an

14 animal, an animal can be killed. If a protected species of wildlife is found, the competent authority for nature protection shall be notified. Temporary accommodation of pets Article 26 Temporary accommodation of pets are pens and shelters for abandoned animals (pets). Pensions and shelters can be established by companies and entrepreneurs, or other legal entities Locations on which animals' accommodation will not disturb public order and peace. Objects for the temporary accommodation of pets referred to in paragraph 1 of this Article must be fulfilled by veterinary sanitary facilities conditions. In the facilities referred to in paragraph 1 of this Article, an employed person must have been trained for animal care. In temporary accommodation facilities, animal health care must be provided. The use of the service of a board is concluded in written form between the service provider and the user. The user is obliged to submit the certificate on the check before the beginning of the use of the boarding services health condition and pet vaccination. The administration body keeps a register of temporary accommodation facilities and determines the fulfillment of the conditions referred to in paragraph 3 of this Article. Closer to the conditions that must be fulfilled by the pensions and shelters from paragraph 3 of this Article, the manner of training persons referred to in paragraph 4 of this Article and the manner of keeping the register shall be prescribed by the Ministry. Establishment of shelter for abandoned animals (pets) Article 27 Shelter for abandoned animals (pets) is obliged to: 1) receives reports of abandoned and lost animals; 2) organize independently or in cooperation with local self-government units, collection and transportation lost and abandoned animals to the shelter; 3) take over the abandoned and lost animal and provide it with accommodation; 4) provide veterinary-health protection of animals; 5) Seek the holders of abandoned and lost pets or pets home pets; 6) keep records of the animals found and their care or killing. If the pet owner has not submitted a request for his return within 15 days from the date admission to a shelter, a pet can be accommodated.

15 The person who has found the animal found must sign the statement of domicile. If a pet does not take it or provide it to another person within 30 days from the day it is placed in the shelter way can be killed. The manner of keeping the records referred to in paragraph 1, item 6 of this Article shall be prescribed by the Ministry. Data from the records are public. The conditions and way of keeping pets, the way to treat abandoned and lost animals (pets), the manner of care and control of their reproduction is prescribed by the competent authority local self-government. Article 28 If no shelter for abandoned animals (pets) has been established in accordance with Article 26 paragraph 2 of this law, its establishment and work is financed by one or more units of local selfgovernment in accordance with their needs. The collection of abandoned and lost animals is organized and financed by local self-government units. Dangerous animals Article 29 A dangerous animal can be kept only if it does not endanger the lives of humans and other animals and their body integrity. A warning must be indicated on objects or places where a dangerous animal is held visible sign indicating danger. It is forbidden to reproduce dangerous animals. Hazardous dogs can only be conducted in public places, and they are subject to direct and continuous supervision holder. It is forbidden for persons under the age of 16 to carry hazardous dogs to public places. The conditions and manner of keeping dangerous dogs and other dangerous animals shall be prescribed by the Ministry. VII. PROTECTION OF ANIMALS WITH TRANSPORT Article 30 Loading, transhipping, unloading and transport of animals must be carried out in a way that will not affect animals cause pain, injuries, unnecessary suffering or death. During loading,

16 transhipment, unloading and transportation the animals must not be deprived of basic physiological needs. Animal transport is forbidden: 1) that are not capable of transporting - high-grade females in the last 10% of the total period duration of pregnancy and females in the first seven days after delivery, unless an emergency veterinary is required help, newborn animals in which umbilical cord is not completely healed, sick or injured animals, unless transport is necessary for the purpose of treatment, forcible slaughter or forcible deprivation animal life; 2) in uncovered means of transport, boxers, containers and other equipment in which animals are not protected against adverse weather conditions and climatic conditions; 3) in warm months, in closed vehicles, boxers, containers and other equipment, if adequate ventilation is not provided during transport; 4) which are sensitive to temperature differences, if during the transport is not provided adequate permanent temperature; 5) if the means of transport does not meet the prescribed conditions; 6) if the minimum prescribed floor area and height, suitable for type and age, are not provided animals and duration of the journey; 7) if the accommodation in the means of transport is such that it is possible to injuriate or leave the animal from means of transport; 8) if during the transport cannot be provided feeding and feeding, first aid and veterinary care for diseased and injured animals; 9) belonging to a group of aquatic animals if no sufficient quantity of water is provided temperatures, oxygen concentrations and food; 10) bee hive, if adequate ventilation is not provided; 11) if substances are transported with animals that are harmful to their health; 12) which the veterinary inspector or the authorized veterinarian has not issued a permit for transport; 13) containers that have not been marked, and in which they are clearly not recognizable by their properties transport animals. Transport of animals contrary to paragraph 1 of this Article is considered torture of animals. Conditions of transport Article 31 The means of transport must be managed in a way to avoid injuries and animal suffering and protection their safety. Animal loading and unloading equipment and equipment must be maintained and used in such a way as to avoid pain, suffering and harm to animals and to protect their safety. Animals must be monitored regularly during transport. The animal transported container must be marked if it is not clearly visible from the outside. The carrier is obliged, prior to the commencement of the transport, to draw up a road map that must be in the vehicle during transport. Obligations of the carrier Article 32

17 Transportation of animals can be performed by companies and entrepreneurs registered for this activity (further text: carrier). Transportation of animals can be carried out with means of transport that meet veterinary and sanitary conditions. The administration body shall keep a register of the carrier and determine the fulfillment of the conditions referred to in paragraph 2 of this Article. The carrier shall: 1) undertake all measures during transportation to reduce the duration of transport as much as possible; 2) to provide a person who has been trained (hereinafter: accompanying animal) for the care of the welfare animals during transport. Exceptionally from st. 1 and 2 of this Article, the transport of animals for own needs may be carried out by farmers by their own means of transport in the following cases: - in case of seasonal migration of animals to other climatic areas; - at a distance of up to 50 km from its farm. St. 1, 2, 3 and 4 of this Article and paragraph 5 of Article 31 of this Law shall not apply to the transport of pets own means of transport and animal transport due to the provision of veterinary and health services transport of animals that are not intended for commercial purposes. The provisions of paragraph 1 and paragraph 4 item 2 of this Article and Article 31, paragraph 5 of this Law shall not apply to persons which transport animals at a distance of up to 65 km, counting from the point of departure to the destination. Closer conditions for carrying out transport of animals that must be fulfilled by the carrier, means of transport, the content of the road plan referred to in Article 31 of this Law and the manner of training of the animal follower shall be prescribed Ministry. VIII. CONDITIONS OF STAYING OF ANIMALS IN ZOOLOUS GARDENS, ACCESSORIES, RELATED TO RECEIVERS Article 33 A zoo, a shelter, or a farm of wild animals, can be established by companies, entrepreneurs and other legal entities if they have: - facilities, space, equipment and employed a sufficient number of persons for holding or reproduction of wild ones animals; - a zoo maintenance program with a list of animal species, the necessary financial resources, and plans for the care of possible progeny; - plan for the disposal of animals in case of closure or natural disasters. Wild animals in zoos can be kept only in objects that fulfill veterinary-sanitary conditions. The fulfillment of conditions from paragraph 1 and 2 of this Article shall be determined by the administrative body by a decision. With the request for establishing the fulfillment of conditions from paragraph Paragraphs 1 and 2 of this Article shall be accompanied by the approval of the Authority responsible for nature protection. A zoo that meets the requirements of st. 1 and 2 and this Article shall be entered in the register maintained by the administrative body. Closer conditions from st. 1 and 2 and the manner of keeping the register referred to in paragraph 5 of this Article shall be prescribed by the Ministry. Protection of animals in zoos, shelters, or nurseries Article 34

18 Zoo must provide: - accommodation and equipment for keeping or reproduction of wild animals that satisfy them the basic needs of each animal species; - adequate food and water according to physiological needs; - veterinary-health protection; - the human attitude of the employees to the animals; - protection of animals from visitors, or protection of visitors from animals. In case of stopping the work of the zoo, the zoo is obliged to give the animals to another zoological a garden that meets the requirements for keeping animals in terms of protection established by this Law. If there is no possibility of taking care of animals in accordance with paragraph 2 of this Article or otherwise animals must be killed. Animals raised in a zoo can be exchanged between zoos with consent administrative authority. The zoo is obliged to keep a record of settled, sold, exchanged or donated animals. The expenses for the care of animals referred to in paragraph 3 of this Article shall be borne by the zoo, shelter, or nursery. The manner of keeping records from paragraph 5 of this Article is prescribed by the Ministry. Protection of animals used for circuses and other animal performances Article 35 Exhibitions, competitions, circuses and other travel events with animals can be organized only if do not jeopardize the life and welfare of animals and do not force animals to behave indiscriminately, or if they are aesthetically acceptable and ethically justified and do not ruin the physical and psychological traits of animals, and basis of the license issued by the competent local authority. It is forbidden at the exhibition or competition to participate in animals where any intervention has been carried out referred to in Article 10 paragraph 1 after the entry into force of this Law. It is forbidden to hold, or reproduce and use wild animals for exhibitions and competitions. The competent authority of the local self-government, on the basis of the request, issues a license for the organization of exhibitions, competitions, circus and other traveling events with animals, with the consent of the administrative body. In addition to the request referred to in paragraph 3 of this Article, evidence of the provided location, data on the types and number shall be attached animals and data on the time of holding exhibitions, competitions and circus and other traveling events with animals. Protection of animals used for film and television shooting Article 36 Animals can be used to film films and TV shows with the consent of the administration authority. The consent referred to in paragraph 1 of this Article shall be issued on the basis of a request submitted at least seven days before the beginning of the recording. A list of all animals to be used (type and number) is attached to the request, information on the previous one the way of keeping and using animals, the purpose of use and the address of the recording. IH. PROTECTION OF ANIMALS USED IN EXPERIMENTS

19 Article 37 Experiments on animals can be performed by higher education and scientific research institutions that are registered for performing experiments on animals. Article 38 Animal experiments can be performed for: 1) research of diseases and physical problems or the recognition of the effects of physiological and pathological conditions in humans or animals; 2) research and development of medicines and medicinal preparations intended for the protection of human and animal health; 3) testing the quality, efficacy and harmlessness of drugs, substances or products; 4) tests of production and other characteristics of animals and ways of their improvement for all types breeding; 5) research into the causes and consequences of endangering the environment; 6) testing the harmfulness of materials or products for human or animal health; 7) scientific research; 8) education. Animal experiments can only be performed if the purpose of the research can not be achieved by others scientific methods and if the assumed pain, suffering, or injury to animals can be ethically justified expected results that are important for humans or animals, or science. The method of keeping experimental animals is prescribed by the Ministry. Marking Article 39 Animals used for experiments must be labeled in accordance with the Ministry's regulations. Approval to perform the experiment Article 40 Animal experiments may be carried out on the basis of an approval issued by an administrative authority on the basis of requirements. In addition to the request referred to in paragraph 1 of this Article, the expert opinion of the Council for Animal Protection shall be attached (hereinafter text: the Council) on the ethical and scientific justification of performing the experiment.

20 The approval referred to in paragraph 1 of this Article shall be issued by the administrative body on the basis of the expert opinion of the Council. Experiments for educational purposes Article 41 Experiments for educational purposes cannot be carried out if they cause pain, suffering, fear, stress, injury or death of an animal. In primary and secondary schools, they are allowed to carry out exercises on live animals that are obsessive character and which emphasize the importance and diversity of animal life, specificity, diversity and the beauty of their appearance and structure, biological characteristics, as well as the specificities and characteristics of the habitat, nutrition, reproduction, behavior and environmental impact. Article 42 Higher education institutions, for the purpose of training students based on curricula, can use for the educational purposes of a living animal if their lives and well-being are not disturbed, that is physical and mental integrity. Other animal interventions, in order to train students, are carried out on animal corpses. The teaching plans and programs referred to in paragraph 1 of this Article shall define the manner of conducting the exercises on live animals. Article 43 Higher education and research institutions must keep records of the experiments carried out on animals and procedures carried out in the production of biological products and on the number of used ones animals. The method of keeping records is prescribed by the Ministry. Article 44 The report on the results of the experiments of the scientific and research institution is submitted to the Ministry, the body administration and the Council within 30 days of the completion of the experiment. Annual report on performed experiments on animals of higher education institutions is submitted The Ministry, the administration body and the Council for the previous year, by March 31 of the current year at the latest. Prohibition of the use of animals for experiments Article 45 It is forbidden to use animals for experiments for:

21 1) testing of weapons, ammunition or related equipment, war equipment and radiation effects; 2) researching or developing tobacco products and chemicals for washing and disinfecting objects general use; 3) research or development of ingredients, combination of ingredients and finished cosmetic products, except for the case where there are no other scientific methods that replace the use of animals; 4) research into the effects of alcohol and drugs, except in cases where there are no other scientific methods to which they are replaces the use of animals. X. COUNCIL The composition and the way the Council works Article 46 The council is established by the Government. The council has a president and six members. The Council is appointed by the Government, six of which are proposed by the Ministry, and one is a non-governmental member animal protection organizations. Members of the Council are appointed for a period of five years. Members of the Council are appointed from among the prominent public scientific and professional workers in the field of veterinary, medical, biological, pharmaceutical-biochemical and agricultural professions. The work of the Council is public. The organization of the Council is regulated in more detail by the Rules of Procedure. Professional and administrative technical tasks for the needs of the Council are performed by the Ministry. Jurisdiction Article 47 Tip: 1) monitors the development of scientific and expert knowledge in the field of animal protection and proposes a method of improvement protection of animals in Montenegro; 2) provides expert opinion on issues of ethics and animal protection in animal use procedures for experiments; 3) provides expert and scientific support for improving the welfare of animals; 4) initiate the adoption or amendment of the regulations for the protection of animal welfare; 5) submit a report on the status and protection of animals in performing experiments and report on its work to the Government Montenegro (hereinafter: the Government), at least once a year; 6) cooperate with competent state authorities, administrative bodies and international organizations institutions in the field of exchange of scientific and professional information; 7) issue rules of procedure for its work; 8) perform other tasks in accordance with the law and the Rules of Procedure. HII. INSPECTION SUPERVISION Authorities Article 48

22 Inspection supervision over the implementation of this law is carried out by the administrative body. Inspection supervision activities referred to in paragraph 1 of this Article shall be carried out by veterinary inspectors in accordance with the law. Authorities of the inspector Article 49 In addition to the authorization of inspectors determined by the law regulating inspection supervision, veterinary the inspector has the authority to: 1) performs inspection and control of facilities and premises in which animals are kept or reproduced; 2) control the traffic, transport, killing and slaughter of animals, conducting experiments, organization of exhibitions, competitions, circus and other performances with animals; 3) control the safety of animal conditions with regard to holding and breeding; 4) control the fulfillment of the conditions of the pens and the pets shelter; 5) performs control over fulfillment and other conditions in performing inspection supervision. Administrative measures and actions Article 50 In addition to administrative measures and actions determined by the law regulating inspection, veterinary the inspector has the authority and obligation to: 1) order measures for removing detected irregularities within a specified period; 2) prohibit fighting between animals and animals and humans; 3) prohibit the implementation of operations on animals not carried out by a veterinarian; 4) prohibit the killing of animals by a person who is not professional for that purpose; 5) prohibit loading, loading, unloading and transport of animals if the conditions for protection of animals are not met; 6) temporarily prohibit slaughter which is performed without stunning in the manner prescribed by this Law; 7) order removal of irregularities in the work of pens and shelters within a specified period; 8) temporarily seize documents and objects that may serve as a misdemeanor procedure proof;

23 9) temporarily placed under the control of an animal in the state on the basis of which it can be concluded that the animal suffers from pain, suffering or great fear, that it is damaged or that the continuation of her life under the same conditions was associated with incurable pain, to eliminate irregularities; 10) orders an interruption of the experiment or prohibits the performance of the experiment on the animals being administered contrary to this law, or if the deficiencies relating to the implementation of the experiment have not been corrected prescribed deadline; 11) order removal of irregularities in the operation of zoos within a specified time limit; 12) orders the undertaking of other measures to ensure the removal of identified irregularities. If the irregularities referred to in paragraph 1 point 9 of this Article are not remedied within the time limit, the animal may be executed at the expense of the owner or if it is an animal pet animal can be given to a shelter for abandoned animals. HII. PENALTY PROVISIONS Article 51 A fine ranging from twenty to two hundred times the lowest labor costs in Montenegro a legal entity and an entrepreneur shall be penalized if: 1) does not treat the animal well with the care of the animal (Article 4, paragraph 3); 2) does not prevent an animal from endangering the life, safety or property of another person, that is, life and safety other animals (Article 4, paragraph 5); 3) does not provide assistance and does not provide veterinary assistance in the event of an injury, illness or difficulty in delivery (Article 5); 4) leave the animal, pet or breeding wild animal or other animal holding supervision (Article 8, paragraph 1, item 1); 5) grows or reproduces animals so that they suffer pain, suffering, fear and deliberately harm them (Article 8 paragraph 1 item 3); 6) increases the aggressiveness of animals by selection or other methods (Article 8, paragraph 1, item 4); 7) the hounded animal to other animals or humans, or accuses them of being aggressive (Article 8, paragraph 1, item 5); 8) training animals for fighting, organizing animal fights or fighting animals and humans, participating in visits them, visits them and advertises and organizes betting and participates in betting (Article 8, paragraph 1, point 6);
