1 THE CORPORATION OF THE TOWN OF GRAVENHURST BY-LAW NO. Being a by-law for the purpose of setting up and adopting rules and regulations of Municipal Cemeteries in the Corporation of the Town of Gravenhurst, pursuant to The Funeral, Burial and Cremation Services Act 2002, S.O C.33. WHEREAS Section 150(1) of the Funeral, Burial and Cremation Services Act 2002, S.O. 2002, C.33 provides that the owner of a cemetery may pass by-laws for the operation of the cemetery. AND WHEREAS it is deemed expedient to set up and establish certain standards for the operation and control of cemeteries under the jurisdiction of the Municipality. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF GRAVENHURST ENACTS AS FOLLOWS: 1. The Rules and Regulations of Municipal Cemeteries in the Corporation of the Town of Gravenhurst, as set out in Schedule A attached hereto, are hereby adopted. 2. Schedule B, cemeteries owned by the Corporation of the Town of Gravenhurst, and Schedule C, Cemetery Tariff of Rates, attached hereto, hereby form a part of this by-law. 3. The effective date of this by-law shall be the date it is approved by the Registrar. 4. 2 - 2 - SCHEDULE A I. GENERAL INFORMATION FOR VISITORS 1. Hours of Operation Visitors are welcome in all cemeteries from sunrise to sunset. Generally, it is advisable that visitors refrain from entering the cemeteries at all other times in the interest of the public safety or if the gates are closed. 2. Dogs and other pets are not allowed on the cemetery grounds. If brought in by car, they must be securely confined within the vehicle during their stay. 3. Children under twelve (12) years of age should be accompanied by an adult who shall maintain close contact with them and shall be responsible for their actions. 4. Carriages and motor vehicles shall remain on cemetery roadways at all times and refrain from turning or driving on the boulevards, pathways or green space. 5. The use of motorized recreational vehicles is strictly prohibited. 6. All visitors are prohibited from taking flowers, plants or other materials from plots in the cemetery other than from their own plots. No person shall pick flowers, either wild or cultivated, break any tree, shrub or plant, or write upon or deface or injure any monument, fence or other structure in or belonging to the cemetery. 7. No Person shall make any paths or short cuts across any part of the cemetery, or play at any games in the cemetery. 8. Memorial Services without interments occurring may be permitted in the cemetery. However, 48 hours of notice must be given and the permission acquired from the Corporation before proceeding. 9. The throwing of rubbish or refuse on cemetery grounds is strictly prohibited and must be placed in the receptacles provided or removed from the cemetery. II. SALES AND TRANSFERS OF INTERMENT RIGHTS 1. Payments for interment rights shall be made at the office of the Treasurer of the Corporation. A schedule of fees and tariffs will be supplied upon request.

3 Each purchaser of interment rights shall be entitled to a interment rights certificate but only when all indebtedness has been satisfied and all charges on the plot have been paid. 3. The interment rights certificate shall specify the size of the plot, the number of the plot, the number and date of cemetery plan and the amount paid, and shall be subject to the existing regulations as may from time to time be determined upon by Council and approved by the Minister empowered, as if embodied therein in full. 4. To ensure the correctness of records of ownership and interments, a transfer of any interment rights or any interest therein shall not be binding upon the Corporation until notice in writing has been given to the Clerk of the Corporation specifying the name, address and occupation or other description of the proposed transferee and date, and such particulars shall be kept in a register for that purpose. Upon receipt of notice, and the payment of a fee, the transfer shall be made. New New New III. 5. The resale of interment rights by the purchaser is prohibited. They must be sold back to the corporation at the current market value, minus the amount paid into the care and maintenance fund in relation to those rights. 6. The purchase of interment or scattering rights for the sole purpose of reselling the rights to make a profit ie. financial gain, is prohibited. 7. The Corporation recommends interment rights holders to bequeath their plots and to mention the plot number in their will. Rights holders, or their legal heirs or representatives, only are allowed to sign for any interment in the plot. In the event of the death of a rights owner, The Corporation will require that letters of probate, of administration or other sufficient proof of inheritance be submitted to the corporation by the estate of the deceased Rights Owner before the Ownership of the Rights is assigned or transferred to any beneficiary, heir or next of kin of the deceased Rights Owner. INTERMENTS AND DISINTERMENTS 1. The supervisor of the cemetery, his assistant, or someone in the employ of the Corporation shall be in attendance at each interment. A burial permit or certificate of cremation is required before an interment can be conducted. 2. Persons ordering interment spaces shall be held responsible for all charges incurred. A cemetery services contract must be completed by the interment rights holders, or their legal heirs or representatives before an interment may take place. 3. No interment shall be made without the written order of the owner of the interment rights or the person designated, as provided in these rules, whose name appears on record at the office of the Clerk.

4 No space shall be opened for interment or disinterment by any person not in the employ of the Corporation. Anyone found opening any space other than an employee will be prosecuted. 5. The interment fee includes the opening and closing of the space only. Double depth interments are not allowed. 6. The winter season shall be considered to be approximately November 1 - April 30. Temporary entombment will be made in the Winter Vault, and Committal Services may be held in the Vault. Winter interments may be allowed, however applicants shall be required to pay the costs as established in accordance with Schedule "C" Tariff Rates. The winter vault must be clear of entombments by May 15, except under special circumstances. 7. No entombments shall be permitted in the winter vault unless embalming has taken place or a hermetically sealed container is used. 8. The bodies of persons dying from contagious diseases cannot be admitted to the winter vault during the winter season but must be interred. 9. The increasing use of oversize shells does not permit the Corporation to assume responsibility for the number of interments that may be made in any plot. 10. No interment shall take place on any plot against which unpaid charges appear. 11. The scattering of cremated remains in cemeteries of the Corporation will not be permitted except in the designated area and only by an employee of the Corporation. Prior to scattering, a Permission to Scatter form must be completed by the deceased s legal representative. No decorations other than planted flower bulbs are allowed in these areas. 12. Concrete or cement vaults are recommended but are not mandatory. Vaults will avoid sunken spaces. 13. ORDERS for interment shall be given to the cemetery office at least twelve (12) full working hours prior to the interment. 14. All funerals arriving at any cemetery later than 3:45 p.m. on weekdays will be subject to an extra overtime charge as set out in the schedule of tariffs. INTERMENTS ON SATURDAYS, SUNDAYS AND STATUTORY HOLIDAYS WILL BE SUBJECT TO THIS CHARGE AS WELL. 15. Interments of cremated remains in cremation plots are restricted to two (2) interments per plot. No restrictions apply currently on any other regular plots, except for the Legion section (See Section VII).

5 If, for any valid reason, an employee of the Corporation determines that an interment cannot be made on the day of the funeral, he may direct that the remains be placed in temporary entombment in the vault, and the interment shall be made as soon after the day of the funeral as conditions permit. No charge shall be made for the use of the vault for such service. 17. a) There is a limit of two (2) cremation interments in each niche. Niches are of a standard inside size of eleven and one half inches by eleven and one half inches by eleven and one half inches (11 ½ X 11 ½ X 11 ½ ). The condition of any urn on subsequent openings and oversize urns that may not be accommodated in the niches are not the responsibility of the Corporation. b) No embellishment may be attached to any niche front and only the approved style of inscription of the Corporation will be allowed. c) The price of the Columbarium niche includes the inscription work and the opening and sealing of niches and will be performed by employees of the Corporation only. Overtime charges will be extra as well. d) Columbarium decorations will be permitted in the appropriate area only. Please contact Supervisor for details. 18. Animals bodies shall not be interred in the cemetery. 19. Cemetery Staff, Law Enforcement Officers, Ministry Representatives or Funeral Home Staff only shall be permitted at disinterments.

6 - 6 - IV. CARE OF LOTS 1. Since provision has been made for care and maintenance, the Corporation undertakes the grading, seeding, grass cutting and general care of the plot. 2. Flowers, plants and shrubs may be placed in the Cemetery at the approval of the supervisor under the following general directions: New New (i) (ii) (iii) (iv) (v) (vi) Cut flowers and hanging baskets and potted plants are allowed on all plots, except for flat marker cremation plots. One cut flower arrangement only may be placed on these plots at any one time to facilitate maintenance procedures. Hanging basket stands will be removed from all plots if left empty. Ornamental evergreen shrubs of dwarf nursery stock are allowed on all plots of two graves or more, with monuments. They must be placed in line with the monument and be of reasonable size and shape, and not to interfere with plots on either side. Before purchasing shrubs it is recommended that the supervisor be consulted for suggestions about type and size. The Cemetery reserves the right to prune any shrubs that grow too large, or remove such shrubs or parts that interfere with maintenance or become detrimental to the appearance of the cemetery. In order to preserve the proper appearance of the grounds, artificial wreaths and artificial flowers from previous years that have deteriorated and create a hindrance to maintenance will be removed by staff. No glass containers or other breakable items of any kind will be permitted in the cemeteries. Flowerbeds are only permitted on plots with monuments with the beds being no wider than 8 inches out from the front of the monument. The exception, being the flat marker cremation sections, where no beds are allowed, or in the Legion section (See Section VII). Any flower or other container shall be in keeping with the dignity and decorum of the cemetery. These include lawn ornaments, stuffed animals, solar or other lights and ceramic or porcelain figurines. New (vii) Prohibited and other articles which are detrimental to efficient maintenance or which constitute a hazard to machinery, employees, or visitors will be removed at once. (viii) Basket or Saddle type wreaths placed on monuments may damage the finish or cause rust streaks and should not be used.

7 Since borders, fences, railings, walls, cut stone copings, crushed rock surfacing and hedges in or around plots become unsightly, they are prohibited. The Corporation in respect of any such enclosures heretofore erected around any plot, which by reason of neglect or age have become unsightly or objectionable, may make repairs or remove these items as to preserve the safety and dignity of the cemetery. 4. No rights owner shall change the grading of their plot, and in the case of any such change, the Corporation may restore the plot to its original grade at the expense of the owner. 5. No unauthorized person shall make any walk, cut any sod or move corner posts or monuments or markers in the cemetery. 6. The Corporation shall not be responsible for loss of or damage to any portable articles left upon any plot. 7. The Corporation distinctly disclaims all responsibility for loss or damage from causes beyond their reasonable control and especially from damage caused by the elements, an Act of God, common enemy, thieves, vandals, strikers, malicious mischief makers, explosions, accidents, invasion, insurrections, riots, order of any military civil author whether the damage be direct or collateral. 8. Any persons doing landscaping or other work on a cemetery plot must contact the Corporation prior to commencement of that work. 9. The Corporation will accept donations of trees from lot owners or others in memorium of the deceased. Please contact the Supervisor regarding type and size. V. MONUMENTS AND MARKERS 1. Any plot is defined as a grouping of individual interment rights spaces consecutively owned by one family, for interment of the family members. A space is defined as the individual space provided for the interment of one person. A plot can have any number of spaces (e.g. a single space plot, a two-space plot, a four-space plot or an eight-space plot). 2. All upright monuments must be placed on concrete foundations, not less than five (5) feet in depth, or the depth of the interment, whichever is the greater. 3. Bench style markers are allowed, however, the bench supports must be rough edged and supported by 15 diameter sauna tubes to a depth of five (5) feet, or a full concrete foundation.

8 No more than one (1) monument shall be erected on any one (1) plot or space. One marker with a flat and level surface set flush with the ground may be placed at each space in addition to the monument. The marker shall be placed at the end of the space farthest from the monument. 5. Footstones of marble or granite are permitted but must not exceed twelve (12) inches by twenty-four (24) inches, with a depth of three (3) to eight (8) inches. The upper surface must be flat with no projections and shall be set level with the ground surface. 6. Corner markers may be purchased from the Corporation and shall be installed by the municipal staff and must be of granite or marble and shall be 6 X 6 with all smooth edges. Where the corner markers are not purchased from the Corporation when interment rights are purchased, they shall be installed by the municipal staff at a charge as set out in Schedule C - Cemetery Charges. 7. An inscription on any monument or other structure, or any monument itself shall be in keeping with the dignity and decorum of the cemetery. 8. The Corporation shall keep all monuments in a state of good repair and safety and do whatever is necessary by way of repairing, resetting or laying down the marker so as to remove any risk. Such repairs shall come under the monument care and maintenance fund of the cemetery. 9. Memorials shall be no more than five (5) feet in total height from ground level unless otherwise approved by the Corporation. 10. (i) All upright style memorials shall be constructed of monumental grade granite and shall be free and clear of defects or natural faults (such as cracks or checks) which could further affect the stability and safety of the memorial structure. (ii) Foot markers and corner markers shall be constructed of granite, marble or bronze. (iii) Statues or Figurines that are Permanent parts of the memorial must be constructed of monumental grade material. (iv) Solar or other types of illuminators are not permitted. (v) Materials other than those mentioned above may not be used for the purpose of memorialization. 11. If a pad is placed under the die portion of an upright memorial, the foundation shall extend out and down to correspond with the pad. 12. Granite bases on memorials shall have rough (rock) edges.

9 Memorials shall have a maximum width of 65 percent of the plot. This will allow adequate space for the purpose of mowing, trimming, etc The tablet or die portion of all upright style memorials shall be a minimum of six (6) inches and a maximum of eighteen (18) inches at the joint. 14. No monument, grave marker, etc. will be allowed on any plot where unpaid charges appear. A cemetery services contract must be completed by the interment rights holders, or their legal heirs or representatives, before the installation of a marker or monument. 15. The Corporation shall take reasonable precaution to protect the property of rights owners, but it assumes no liability or responsibility for the loss of, or damage to, any monument, marker, mausoleum or part of any article of any type that may be placed on any plot. 16. Pictures or photographs are permitted on markers however; the Corporation will not be responsible for any damage to them. Any other attachments must be constructed of a non-corrosive material. 17. Pillow markers with smooth edged tablets shall be installed with a rough edged granite base. 18. Flat markers only may be installed on Mickle cremation section j and Bethel cremation section f. No memorials of any kind may be placed in the woodland scattering section of Lakeview Cemetery. 19. Cleaning or rubbings of monuments shall not be allowed except for qualified contractors or companies experienced in these techniques. 20. The Cemetery reserves the right to remove any markers found to be in contravention of these regulations. New 21. The Corporation shall not be liable if, due to incorrect or improperly authorized instructions, a marker is installed on or removed from a plot; or lettering or carving on any marker or other structure is improperly carried out. VI. MONUMENT DEALERS, CONTRACTORS AND OTHER PERSONS 1. Any employee of a contractor who damages any plot, marker, monument or other structure, or otherwise does any injury in the cemetery, shall be personally responsible for such damage, or injury. In addition, the employer of the said worker shall be liable. 2. Discharging of firearms, other than in regular volleys at Interment Services is prohibited in and around the cemetery.

10 Any complaints by rights owners or visitors about any workers should be made to the Cemetery Supervisor, and not to others on the grounds. Controversies with others on the grounds are to be avoided. 4. Notice must be given in writing to the Corporation at least forty-eight (48) hours in advance of any monumental work to be done in any of its cemeteries. 5. All monument dealers, contractors and workers on the cemetery grounds must comply with all conditions as set out by the Occupational Health and Safety Act. 6. Any Monument Dealers, Contractors or other workers working in the cemeteries must provide a Certificate of Liability Insurance as well as Proof of Coverage by the Worker s Safety and Insurance Board. VII. ROYAL CANADIAN LEGION BRANCH 302 Cemetery Section 1. The area will be known as The Cemetery of the Royal Canadian Legion, Harry Wray Branch 302, Gravenhurst. 2. This Cemetery area is a Memorial to those who died in the service of their country in both world wars and subsequent wars. 3. (a) This area has been established to provide a fitting place in good surroundings for the burial of those who have served their country in war or in peacetime. (b) (C) Eligibility for burial in this cemetery area are those who would be accepted by the Royal Canadian Legion as regular members. The spouse of a veteran may, on request, be buried in the Cemetery area. Should the spouse predecease the husband and be buried in the plot, the husband will purchase two plots on the understanding that the second one will be reserved for him. The privilege of burial in the plot is extended to one spouse only, no other relations allowed. Cremated remains of a veteran or spouse shall be placed in individual plots only and not upon existing graves. 4. The Legion will install on every plot, a flat veteran s marker, giving the veteran s year of birth, year of death, name, and regimental number. On the marker of the spouse will be given the year of birth, year of death, and name. 5. The markers will be installed at ground level. No upright or vertical monuments will be permitted.

11 The cost of providing a marker as stated in section (4) and (5) above, shall be borne by the rights certificate holder or those persons responsible for cemetery arrangements. Please contact Branch 302 for further details. 7. The purchase of cemetery plots shall be made in accordance with reference to regulation 3(b) Legion eligibility. 8. Plot decoration - one hanging basket or wreath may be allowed on each plot. They will be removed once they become unsightly or interfere with the maintenance of this section. 9. No glass or plastic enclosed artificial flowers or glass and ceramic containers are allowed, as well as all other articles mentioned in Section IV parts 2. vi & vii. VIII. OFFENCE Every person who contravenes any provision of the regulations is guilty of an offence and on conviction, where no other penalty is provided is liable to a fine as established in the Funeral, Burial and Creamation Services Act, 2002, S.O. 2002, C.33 of not more than $50, or to imprisonment for a term of not more than two years less a day or both.

12 SCHEDULE B TO BY-LAW NUMBER CEMETERIES OWNED BY THE CORPORATION OF THE TOWN OF GRAVENHURST Mickle Memorial Cemetery - Plan 15, Pt. Lts. 20, 21, 22 & 23 - Muskoka Township, 124 Lofty Pines Drive. Mickle Memorial Cemetery is a 25-acre property purchased by the Town of Gravenhurst in July of 1929 from James Brydon. The cemetery is named in honour of Charles Mickle Sr., a local lumberking and co-founder of the Mickle-Dyment and Son Company. Mr. Mickle and his family are interred in a special family plot in the northwest corner of the property. The cemetery is located on the North Side of Lofty Pines Drive between Muskoka Beach Road (District Rd. #17) and Muskoka Road N. (District Rd. #18) in Gravenhurst, at 124 Lofty Pines Drive. Lakeview Cemetery - Pl.16, Pt.Block W, Pt. Lt.10 Gravenhurst, 230 Wagner St St. Paul s Roman Catholic Cemetery - Pl. 16, Pt. Block W, Pt. Lt Wagner Street, Gravenhurst Lakeview Cemetery, originally a Protestant cemetery and St. Paul s Roman Catholic Cemetery, were created on part of the original Town Plan of Lot 10 purchased from Donald Fraser and David James Wagner in November of These cemeteries together cover approximately 5 acres and are situated on Wagner Street between Emma Street and John Street North in Gravenhurst. The Town of Gravenhurst has maintained Lakeview since its origin, while St. Paul s Cemetery was turned over to the Town in 1971 by the Catholic Church. *Lewisham Memorial Cemetery - Pt. Lt. 5 - Ryde Township, 1707 Lewisham Rd Lewisham Memorial Cemetery was created on October 9, 1885 as a 1- acre grant to The Bishop of Algoma (Anglican Church) by landowners Anthony and Eliza Annis. The cemetery is located near the end of Lewisham Road, summer maintained only, approximately 10 km. east of the Village of Barkway. It was assumed by the Town in Barkway Cemetery - Pt. Lt Ryde Township, 1409 Barkway Road Barkway Cemetery is a 2-acre parcel of land originally purchased by the Township of Ryde from landowner Albert Post on April 26, The cemetery is located 1 km. South of the Village of Barkway on Barkway Road and was assumed by the Town in 1971.

13 *Barkway Pioneer Cemetery - Pt. Lt Ryde Township, Barkway Road Barkway Pioneer Cemetery is a 1-acre parcel of land originally used as a cemetery for the pioneers of Ryde Township. It was donated on September 13, 1880 by landowner Henry Charles Metz and later sold to the Church (unknown denomination) on October 1, It was eventually maintained by the Township of Ryde and was assumed by the Town in The cemetery is located on Barkway Road, one-half kilometre south of Barkway Cemetery. Bethel Cemetery - E.M.R., Lt. 9 - Morrison Township, 1350 Highway #11 N. Bethel Cemetery, in Morrison Township, was part of a lot originally sold to Moses Martin by the Crown on July 20, 1864 and then deeded to the trustees of the Methodist Church on July 3, 1865 to be used as a cemetery. An original church on this property was believed to have burned about Bethel Cemetery is 24-acres in size and is located on the east side of Highway #11 beside Muskoka Tourism, 3 kilometres north of Severn Bridge. The cemetery was assumed by the Town in Morrison United Cemetery(United)-Pt.Lt. D - Wood Township, 2985 Southwood Rd. Morrison United Cemetery is a 1-acre cemetery located on District Rd. #13, 1 km. west of Morrison Lake. This property was sold by William A. Smith to the trustees of The Southwood and Morrison Lake Congregation of the United Church of Canada on November 20, An abandoned church building was located on site. This cemetery was assumed by the Town in Church Of Our Lady Cemetery - Pt. Lt. 5 - Wood Township, 3411 Southwood Rd. Church Of Our Lady Cemetery is a 3-acre cemetery which was created in September of 1927 by Fred Chapman, who donated the land to the Dioceses of Algoma (Anglican). The log structure, Church Of Our Lady, was built shortly thereafter. The Town was approached by Archdeacon John Watson and Fred Chapman on June 7, 1979 to look after the cemetery for the Church. The cemetery is located on the west side of District Rd. #13 in the Hamlet of Southwood, and was completely assumed by the Town in 2001, The log church is currently maintained by The Friends of Church of Our Lady. St. James Anglican Cemetery - Pl. 5, Church L Gravenhurst, 215 Violet St. St. James Anglican Cemetery is a 2-acre parcel of land originally surveyed on the Plan of the Village of Gravenhurst on July 10, 1878 and owned by John Forster Esq. It was officially transferred to the Bishop of Algoma (Anglican) in 1883 as a cemetery. An original wood frame church was located on this site until 1882, when it was re-built at its present location. The cemetery was maintained by the Church until 1993, when it was turned over by request of the Church to the Town. The cemetery is located on the southeast corner of Muskoka Road South and Violet Street in Gravenhurst.

14 Muskoka North (Reay) Cemetery - Pt.Lt. 4 - Muskoka Township, 1025 Heywood Ln Muskoka North (Reay) Cemetery is a 5-acre lot sold by the Crown to the Corporation of the Township of Muskoka for use as a cemetery on May 13, It continued as a Township cemetery until 1971 when it was assumed by the Town. The cemetery is located on the southeast corner of Highway #11 and Heywood Lane, and is accessible from Highway #118 east and the Gravenhurst Parkway (District Rd. #1). Symington Cemetery W.M.R.Pt.Lots19 & 20, Morrison Township, 1010 Kilworthy Rd. Symington Cemetery is a 1-acre lot originally donated by the Symington family in 1862 to be used as a non-denomination burial ground for local residents. It was controlled by a Cemetery board until August of 2001, when it was transferred to the Town s ownership. The cemetery is located on the northwest corner of Kings Highway No. 11 and the Kilworthy Road. * Lewisham Memorial Cemetery and Barkway Pioneer Cemetery are inactive, care and maintenance only. Upon proper Proof of Burial Rights, the Corporation may give its permission for burial in these cemeteries.
