2 shall board the dog and, if training has been agreed shall perform the agreed training services on the terms and conditions of this agreement. 1. Puppy Training 1on1 agrees to keep its kennel premises sanitary and properly enclosed; to feed the dog properly and regularly and to house it in clean, safe quarters. 2. Puppy Training 1on1 shall operate to the best of their abilities in boarding and/or training the dog; and having done so, shall be without liability for loss or damage from disease, death, running away, theft, fire, injury to persons, other dogs, or property by said dog, or other unavoidable causes, either during or after boarding and/or training. 3. Puppy Training 1on1 will brush, clean and groom the dog at least twice weekly. The dog will not be taken off the premises except by the consent of the owner, or for permitted veterinary care. 4. If the dog becomes seriously ill, the owner shall be notified at once if no particular veterinarian has been designated. If the owner does not inform immediately regarding measures to be taken, or if in Puppy Training 1on1 judgment, the state of the dogs health reasonable demands quick action, Puppy Training 1on1 shall have the right to call a veterinarian, as designated above or if none is designated, to call a veterinarian of its choice or to take the dog to the said veterinarian in either case; or administer medicine or give other advisable attention, within its discretion and judgment, and such expenses, being reasonable in amount, shall be paid promptly by the owner of the dog. OWNERS ACKNOWLEDGEMENTS AND REPRESENTATIONS 5. THE OWNER ACHKNOWLEDGES THAT THERE ARE NO REFUNDS, REIMBURSEMENTS, RETURNS OR EXCHANGES ON ANY OF OUR SERVICES OR PRODUCTS UNDER ANY CIRCUMSTANCE. 6. The owner represent that he is the legal owner of the dog; that title to said dog is not mortgaged in any way, that the dog has not been exposed to distemper or rabies within the last thirty (30) days; and that the required annual license has been obtained. 7. The owner acknowledges that he has been advised of and understands the following matters concerning training: Puppy Training 1on1 undertakes to perform training competently and professionally, but cannot and does not assume responsibility for factors influencing the dogs behavior and performance after the dog is released to the owner. Such factors include, but are not limited to, the dog s health, the environment, intelligence, disposition, home environment, and the manner in which he is handled, treated and cared for at home. It is the owner s responsibility to return to Puppy Training with the dog for follow-up training. Upon completion of boarding and training, the dog will be trained to obey packaged commands on leash, and to perform such other training as has been agreed. The effectiveness of such training after the dog is released to the owner is dependent upon the owner learning to handle the dog properly; and upon the transference of the dog s skills and obedience from the trainer to the owner. All necessary follow-up training (10+ lessons) offered to the owner at no extra charge (Program 3 Only), and the follow-up training voids all responsibility on the part of, its officers and employees, for the result of such training. If any charges for boarding, training, medicine, or veterinary services are not paid within (10) days after they are due, or if the dog is not called for within ten (10) days, the dog will be sold within ten (10) days after this period by publicly, privately or otherwise for the best price available. Notice in writing of such intended sale shall be mailed by registered mail to the owner of the dog at the address given hereon, not less than (10) days before date of such intended sales, and no further notice shall be deemed necessary. Any excess amount over charges will be given to the owner: any deficiency is to be paid by the owner. 9. This agreement contains all of the representations, warranties, agreements of the parties and supersedes all prior understandings or representations, written or oral, between the parties. 3 Congratulations! Your decision to have your dog professionally trained will bring you the pleasures of an obedient and loving pet for years to come. Thank you for choosing. Below will explain our TWO PHASE Training Program that both you and your dog will go through. PHASE I: From the moment you leave your dog with it will begin learning the five basic obedience commands heel, sit, down, stay and come. He/she will also learn the meaning of the word NO. Behavioral problems, such as, housebreaking, destructive chewing, unnecessary barking, biting, jumping, etc., are not covered during Phase I. (These are worked on after your dog returns home, free of charge (Program 3 only), but with no guarantee. Your dog learns through use of proper voice tone, praise, love, and proper leash corrections, NOT through punishment. Your dog will be trained by men and women, in the cleanest and most sanitary conditions possible. We disinfect our kennel areas atleast 2 times daily. Your dog is worked up to four times daily, fed and watered under the utmost sanitary conditions, and has play periods to insure a relaxed eager attitude to learn. He/she will be bathed and have his/her ears cleaned on the day of pick-up. Pick-up date is most important, please be prompt allow about one hour and bring ALL adult members of your household. Upon pick-up, we begin Phase II of our Program, training you and your dog together as a team. PHASE II: Normally, Phase II takes 3 to 5 lessons for you to learn to handle your dog properly. These lessons are by appointment, and will be conducted at. Naturally, you have to come to Phase II lessons if your dog is to obey you. If you don t take Phase II lessons, your dog won t work for you. Lessons MUST be utilized in 6 months after dog is released from boarding program. The first part of Phase II will be devoted to counseling on behavioral problems such as housebreaking, chewing, barking, biting, and jumping. Your training instructor will discuss effective methods to eliminate these bad habits with you. We have found that when owners follow our methods exactly, they have a 90% success rate. However, when they alter these methods even slightly, less than half of the problems are solved. Please follow our directions exactly, have confidence, and they will work. Next, our training instructor will show you how to handle your dog correctly through proper voice, leash handling and commands, also proper corrections. Correction is a method of reinforcing commands. Without corrections, your dog will not know what is expected of him. Next, you will be shown the commands your dog has learned. After a happy reunion, our training instructor will teach you how to command your dog to heel and sit. All adult family members are included. Your next lesson will be scheduled about a week from pick-up date. During these two weeks you and all family members should practice with the dog two times daily for about ten minutes. It is important, for without practice, you won t command correctly and he won t respond to you. Quality, as opposed to quantity, is our rule. Only do one or two commands per week. Take your time please don t get ahead of your scheduled program. If you are enrolled in Program 3 or any advanced custom program, expect to attend a few additional lessons. 4 PUPPY TRAINING 1ON Benson Poole Road, Smyrna GA Board and Training Agreement Addendum Once a client is notified that their dog has completed the training program, Puppy Training 1On1 will call to setup a pick-up appointment where you will be able to bring your dog home after reviewing his/her training. We will make every effort to accommodate your scheduling needs however; if you do not pick up your dog, or make arrangements to have your dog picked up within 7 days of training completion notification, a boarding fee of $50.00/day plus any bathing and/or food costs will be added to your final bill. Any outstanding balance must be paid in full in order for your dog to be released. After 7 days of training and boarding, if you decide to pickup your dog from training, you owe the full amount of money stated on your contract. If you decide to pick up your dog before 7 days, your cost will be prorated at $ per day. No refunds will be given after the 7 days. This contract is legal and binding and no refunds will be given. 5 PUPPY TRAINING 1ON1 MEDIA RELEASE For good and valuable consideration, the receipt of which is hereby acknowledged, I, hereby authorize permission to use my and/or my dog s likeness in a photograph(s)/ video(s) in any and all of its publications, including but not limited to all s printed and digital publications. I understand and agree that any photograph(s)/video(s) using my own and/or my dog s likeness will become property of. I acknowledge that since my participation with is voluntary, I will receive no financial compensation. I hereby irrevocably authorize to edit, alter, copy, exhibit, publish, distribute this and all photographs/ videos for the purpose of publicizing Puppy Training 1On1 s programs or for any other related, lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or relating to the use of photograph(s)/video(s). I hereby hold harmless and release forever discharge from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other person acting on my behalf, or on behalf of my estate or may have by reason of this authorization. 6 Owner Liability Waiver In consideration of the services rendered by (the Company and sometimes referred to herein as Puppy Training ), I have read, understand, acknowledge and agree as follows: I hereby release, its employees, owners, directors, representatives, subcontractors, agents, animal owners, customers and potential customers from any and all liabilities, financial and otherwise, for injuries to myself, my dog, or any other property of mine, which arise in any way at any time directly or indirectly from services and/or products provided by or as consequence of my association with. I agree to assume all liabilities and responsibilities, financial and otherwise, for the behavior and health of my dog. In consideration of the services rendered by, I hereby waive any and all claims, actions or demands of any nature foreseen or unforeseen, including without limitation any claims relating to the care, control, health, and/or safety of my dog, claims arising during training, pick-up or drop-off of my dog, and/or any boarding services for my dog, relating to, resulting from or arising out of my involvement with or participation in any activity of Puppy Training 1On1 that I may have against, its employees, owners, directors, representatives, subcontractors, agents (collectively, the Releasees ). I hereby agree to indemnify, defend and hold harmless the Releasees from and against any and all claims, damages, injuries, losses, liabilities, expenses, or injuries arising directly or indirectly as a result of any action by my dog or any other dog including any claims by myself, my family members or any other person accompanying me to or present with me at any function, program, event or activity of. I authorize to do whatever they deem necessary for the safety, health, and wellbeing of my dog while under the care of, including seeking professional veterinary treatment for my dog as deemed reasonably necessary by in its sole and absolute discretion. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY AND IN NO EVENT SHALL PUPPY TRAINING 1ON1 OR ANY OF THE RELEASEES BE LIABLE, JOINTLY OR SEVERALLY, TO ME OR ANY OTHER PERSON AS A RESULT OF OR IN CONNECTION WITH THE SERVICES OFFERED TO MY BY PUPPY TRAINING 1ON1, INCLUDING, WITHOUT LIMITATION, FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, LOST PROFITS, LOST SAVINGS, AND LOST REVENUES, OR OTHER PECUNIARY LOSS (COLLECTIVELY, THE EXCLUDED DAMAGES ), WHETHER OR NOT CHARACTERIZED IN NEGLIGENCE, TORT, CONTRACT, OR ANY OTHER THEORY OF LIABILITY, EVEN IF PUPPY TRAINING 1ON1 OR THE RELEASEES HAVE BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN ANY OF THE EXCLUDED DAMAGES, AND IRRESPECTIVE OF ANY FAILURE OF AN ESSENTIAL PURPOSE OF A LIMITED REMEDY. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN THE LIABILITY OF PUPPY TRAINING 1ON1 WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW. WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL PUPPY TRAINING 1ON1 BE LIABLE FOR ANY CLAIM, LOSS, COST, EXPENSE, OR DAMAGE WHATSOEVER TO ME OR ANY THIRD PARTY IN AN AMOUNT EXCEEDING THE SUM ACTUALLY PAID BY ME TO PUPPY TRAINING 1ON1 DURING THE TWELVE-MONTH PERIOD IMMEDIATELY PRECEDING THE DATE ON WHICH PUPPY TRAINING 1ON1 IS NOTIFIED OF SUCH CLAIM IN WRITING.

7 Due to the many outstanding benefits of dog socialization and s commitment to the safety and well-being of my dog, I agree that that the benefits of dog socialization outweigh the risks. I understand that has the right to refuse service to me and/or my dog at any time for any reason. I understand that if my dog has a history of or repeatedly demonstrates aggression or biting of humans or animals, reserves the right to refuse service. I understand that all bites may be reported to the local authorities to the extent required by law. I hereby declare to that I am the legal owner of my dog; that my dog has not been exposed to distemper, rabies or parvovirus within the past thirty (30) days, that my dog has been inoculated as indicated by records presented. 8 Off-Premise Training Consent To better exposure to distractions and unfamiliar environments, may deem it necessary to expose dogs to Off-premise locations and new surroundings. By making a selection below, will be informed on including or excluding your dog from these training outings. Locations may include but are not limited to: Petsmart, Pet supermarket, Pet Supplies Plus, Lowes, Chuck Camp Park and Plaza Parking Lots. 9 Additional Pet owner s assumption of Risk, Waiver, Release and Indemnity Please sign ALL blanks I attest that all the information I have given is true, and that to the best of my knowledge my pet(s) is (are) healthy, current on Rabies, Distemper/parvo combo, and Bordetella* immunizations, and not aggressive (sign). Any dog found to have fleas and/or ticks will be treated at the owners expense. (sign). Normal Hazards: I understand that my dog will be socialized and worked (training) with many other dogs and thereby exposed to normal hazards of community encounters (cuts, scratches, etc.) and I agree that may seek emergency treatment for my dog**, and I agree to assume all medical expenses. (sign) *Bordetella is a canine respiratory illness somewhat similar to the human flu. There are many strains of Bordetella. Dogs are particularly susceptible when under any kind of stress, like being away from family. Thus the name Kennel Cough. Vaccines offered by vets cover most but not all forms of Bordetella. Bordetella Waiver: I understand that my dog can contract Bordetella even if s/he has been vaccinated and I will not hold or any of their employees or clients responsible in the event that my dog becomes ill. (sign) **Injury and/or illness policy: Small cuts, sore paws, scratches, minor tummy issues, elbow callus, etc. are treated with a time out and notification of owner upon pick up. More serious issues such as choking, poor breathing, serious cuts, possible broken bones, prolonged diarrhea, vomiting, etc. are an immediate trip to the vet. (Owner assumes any and all expenses.) We will try to bring your dog to YOUR vet, but if they are closed or unable to help right away we will bring her/him to the nearest available emergency/ veterinary service. We will make every effort to contact you as soon as reasonably possible in the event of any serious health concerns. Senior Pets: I understand that older pets may present certain unexpected situations and I have discussed possibilities with and expressed by preferences should needs arise.
